Review of the Ports Access and Pricing Regime
The regime requires the Commission to periodically review the ports access and pricing regime and deliver a report to the Minister. The Minister is required to table the report in the Legislative Assembly.
The first review was completed November 2018, three years after the commencement of the regime. All subsequent reviews are required to be completed at five-yearly intervals. The Commission completed its second review of the regime and delivered its final report in November 2023. Throughout a review, the Commission consults with the private port operator, port users and stakeholders.
The review assesses whether the regime remains fit for purpose and determines whether:
- there is an ongoing need for regulatory oversight of access to, and pricing of, prescribed services provided by the private port operator
- there is a need to change the form of regulatory oversight of access, and if so, how
- there is a need to change the form of regulatory oversight of pricing, and if so, how
- amendments should be made to the access and pricing regime, and if so, the nature of those amendments.
Any subsequent amendments to the regime is purely a decision for Government and Parliament.
