2024 Electricity Retail Supply Code Review (Retailer of Last Resort Amendments)
The Commission reviewed the Electricity Retail Supply Code to implement a fulsome and legally enforceable retailer of last resort scheme in the Territory.

The Commission published the Final Decision and version 5 of the Electricity Retail Supply Code on 9 January 2025, with a commencement date of 8 February 2025.
The purpose of a retailer of last resort (RoLR) scheme is to ensure that in the event of an electricity retailer failure, arrangements are in place to ensure that relevant customers continue to receive electricity supply.
In 2011, under the Utilities Commission Act 2000 and associated regulations (as in force at the time), the Commission made the Electricity Retail Supply Code which provided for RoLR arrangements (among other matters). However, as part of the previous Review of the Electricity Retail Supply Code, the Commission communicated to stakeholders that different legislation was needed to allow the Commission to implement an effective RoLR scheme. The Commission introduced modified RoLR provisions as an interim solution until legislative changes could be made by the Territory Government.
In 2024, the Electricity Legislation Amendment Act 2023 commenced, providing the Commission with the requisite powers to implement a fulsome and legally effective RoLR scheme through the Electricity Retail Supply Code.
Following consultation with stakeholders through the publication of a consultation paper, and consideration of stakeholder feedback, the Commission published its Final Decision and version 5 of the Electricity Retail Supply Code, with a commencement date of 8 February 2025.
