Compliance Framework and Reporting Guidelines - Draft
A consolidation of the Commission’s Statement of Approach on Compliance (released in January 2012) and Compliance Framework and Reporting Guidelines (released October 2015).
In October 2015, the Commission published final Compliance Framework and Reporting Guidelines following consultation with licensees on draft Guidelines released in July 2015.
The Commission noted upon release of the final Guidelines that it intended to consolidate both the existing Statement of Approach on Compliance and the Guidelines into one document, and considered that amalgamating the documents would provide easier readability for licensees and stakeholders.
The Commission’s consolidation of the documents also provided an opportunity to update the Statement of Approach on Compliance, particularly in relation to changes in the regulatory environment that have arisen since it was published in January 2012, for example the structural separation of the Power and Water Corporation and the market entry of a number of new retailers.
The only substantial changes, as foreshadowed during the release of the final Guidelines in October 2015, is further clarity provided to licensees in relation to concerns about reporting of material breaches and removing the Commission’s Register of Compliance in Appendix B of the original Statement of Approach on Compliance.
In removing the Register of Compliance, the Commission highlights that while it provides guidance on how it assesses what constitutes a material breach, the detailed identification and ranking of compliance obligations remains the responsibility of the licensee. The Commission considers that there is no change in overall position previously stated.
Additional amendments are administrative and typographical in nature, arising from the consolidation of two separate documents.
The final Compliance Framework and Reporting Guidelines (consolidated) will commence 1 February 2016.
