Zenith Pacific (DBS-GTS) Pty Ltd is the owner and operator of certain gas and diesel fired power stations (Tanami power stations) at the Tanami gold mine, where it supplies and sells electricity from the Tanami power stations to the owner of the Tanami Mine, Newmont Tanami Ltd, a subsidiary of Newmont Australia Pty Ltd, for the operation of its Tanami Mine.

Zenith Pacific (DBS-GTS) Pty Ltd sought an exemption from a licence under section 87 of the Electricity Reform Act 2000 which would permit the supply and sale of electricity to Newmont Tanami Ltd.

Following consultation, and with the Minister's approval, the Commission granted an exemption under section 87 of the Electricity Reform Act 2000 to Zenith Pacific  (DBS-GTS) Pty Ltd from the requirement to hold a network and retail licence under section 14(1) of the Electricity Reform Act 2000 , with respect to the operation of its Tanami Mine.
